These Terms of Use constitute a legal agreement between you (the "User") and BehaCare. Continued use of the Site after any modification to these terms implies your acceptance of such changes.
2. Description of Services
BehaCare is a specialized behavioral health and dementia service offering telehealth care across the United States. Our services include:
- Behavioral assessment in dementia
- Guidance and support for families of individuals with dementia
- Emotional and practical caregiver support
- Specialized consulting for Assisted Living Facilities (ALFs)
- Educational resources and informational articles
BehaCare's Services are informational, educational, and supportive in nature. They are designed to complement β not replace β emergency medical care, clinical diagnosis, or formal medical treatment. If you or your loved one experiences a medical emergency, call 911 immediately.
3. Eligibility
To use BehaCare's Services, you must meet the following requirements:
- Be at least 18 years of age
- Be physically located in the United States at the time of receiving the Services
- Provide truthful, accurate, and up-to-date information in all forms and communications with BehaCare
- Have the legal capacity to accept these Terms of Use
BehaCare reserves the right to verify User eligibility and to deny or suspend access to the Services in cases of non-compliance with these requirements.
4. Telehealth Services
BehaCare consultations are conducted through secure video platforms that comply with applicable privacy standards. By using our telehealth services, you acknowledge and accept the following:
- Connection and equipment: The User is responsible for having a stable internet connection and an appropriate device (computer, tablet, or smartphone with camera and microphone) to participate in video sessions.
- Private environment: It is recommended that the User participate in sessions from a private and quiet space to ensure the confidentiality of the consultation.
- Recordings: Telehealth sessions will not be recorded unless both parties β the BehaCare professional and the User β give their express written consent in advance.
- Confidentiality: All information shared during consultations is treated confidentially, in accordance with applicable privacy laws and regulations.
- Technical limitations: BehaCare is not responsible for service interruptions caused by failures in the User's internet connection, equipment issues, or technical circumstances beyond our control.
5. Free Consultation
BehaCare offers a first free consultation of approximately 15 minutes in duration. This consultation is intended for the User to learn about our services and for our team to gain a general understanding of the User's situation.
It is important to note that:
- The free consultation does not create any obligation to contract additional services
- It does not establish an ongoing clinical relationship unless both parties expressly agree to continue with the care process
- The information provided during the free consultation is of an orientative and general nature
- BehaCare reserves the right to limit the availability of free consultations at its operational discretion
6. User Responsibilities
By using BehaCare's Services, the User agrees to:
- Truthful information: Provide accurate, complete, and up-to-date information about their situation, that of their loved one, or their organization, as applicable
- Appointment attendance: Attend scheduled appointments punctually through the telehealth platform
- Cancellations and rescheduling: Notify any cancellation or rescheduling request at least 24 hours in advance of the scheduled appointment time
- Appropriate use: Use the Services only for their intended purposes and in accordance with these Terms of Use
- Not for emergencies: Not use BehaCare's Services as a substitute for emergency medical services. In case of an emergency, the User must call 911 or go to the nearest emergency room immediately
- Mutual respect: Maintain respectful and professional treatment with the BehaCare team during all interactions
7. Intellectual Property
All content on the BehaCare Site, including but not limited to texts, blog articles, graphics, logos, icons, images, videos, educational materials, site design, and software, are the exclusive property of BehaCare or its licensors and are protected by applicable intellectual property laws in the United States.
The User may not, without the prior written consent of BehaCare:
- Reproduce, distribute, or publish any content from the Site
- Modify, adapt, or create derivative works based on BehaCare's content
- Use the BehaCare brand, trade name, or logo for commercial or other purposes
- Systematically extract data or content from the Site using automated tools
The User is permitted to share links to the Site or BehaCare blog articles provided that proper attribution is given and the original content is not modified.
8. Limitation of Liability
BehaCare's Services are educational, orientative, and supportive in nature. By using our Services, the User acknowledges and accepts that:
- BehaCare does not provide medical diagnoses, medical treatments, or pharmaceutical prescriptions
- The information and guidance provided do not substitute the opinion of a physician, psychiatrist, or other duly licensed health professional
- BehaCare is not responsible for decisions the User makes based on information or guidance received during consultations
- The Services do not constitute a substitute for emergency medical, psychiatric, or crisis services
- Results may vary from person to person, and BehaCare does not guarantee specific results from the use of the Services
To the maximum extent permitted by applicable law, BehaCare, its directors, employees, collaborators, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from the use or inability to use the Services.
9. Cancellation Policy
BehaCare applies the following cancellation policy for all scheduled consultations:
- 24-hour notice: The User must cancel or reschedule their appointment at least 24 hours in advance. Cancellations may be made through the scheduling platform, by email, or via WhatsApp.
- Late cancellations: Cancellations made with less than 24 hours' notice may be subject to charges according to the policy in effect at the time of booking.
- No-shows: Failure to attend an appointment without prior notice may affect the User's ability to schedule future consultations and may be subject to charges.
- Cancellations by BehaCare: In the event that BehaCare needs to cancel or reschedule an appointment, the User will be notified as far in advance as possible and offered an alternative time at no additional cost.
10. Business Consulting (Assisted Living Facilities)
BehaCare offers specialized consulting services for Assisted Living Facilities (ALFs), including preparation for compliance with regulations such as Florida's CS/CS/SB 1404 Act and other regulations related to dementia care.
The business User acknowledges and accepts that:
- BehaCare's consulting services are advisory and orientative in nature. BehaCare provides recommendations based on its experience and knowledge, but the implementation of such recommendations is the exclusive responsibility of the facility.
- BehaCare does not guarantee the obtaining of regulatory approvals, licenses, certifications, or specific results derived from the application of its consulting recommendations.
- The facility (ALF) is and will continue to be solely responsible for compliance with all laws, regulations, and standards applicable to its operation.
- Timelines, costs, and scope of consulting services will be mutually agreed upon between BehaCare and the facility through an independent service contract or agreement.
11. Links to Third-Party Sites
The BehaCare Site may contain links to websites, resources, or services operated by third parties. These links are provided solely as a reference and for the User's convenience.
BehaCare does not control, endorse, or assume any responsibility for the content, privacy policies, practices, or availability of third-party websites. Access to any site linked from the BehaCare Site is at the User's sole risk.
12. Modifications to the Terms
BehaCare reserves the right to modify, update, or revise these Terms of Use at any time and at its sole discretion. Modifications will take effect upon their publication on the Site.
The User is recommended to review this page periodically to stay informed of any changes. Continued use of the Site or Services after the publication of modifications constitutes acceptance of the revised terms.
In the event of substantial changes, BehaCare will make reasonable efforts to notify Users through available means, such as email or a prominent notice on the Site.
13. Governing Law and Jurisdiction
These Terms of Use shall be governed by and construed in accordance with the laws of the State of Florida, United States, without giving effect to its conflict of law provisions.
Any dispute arising in connection with these Terms of Use or the use of BehaCare's Services shall be submitted to the exclusive jurisdiction of the competent courts of the State of Florida, United States.
